Dealing with Everchanging Financials

Presented by Angelene Wierzbic, EA, CTRS (1 Hour)

Collection financial statements are meant to report what is happening in the taxpayer’s life now. But what happens when “Now” becomes “Then”?

Situations arise where time has passed and the IRS requests new financials. Practitioners need to know when IRS can do so.

Often when the demand for new information happens, the taxpayer’s financial position has changed. What happens if their position improves? What if it gets worse? When do we withdraw our resolution and look at other options?

You may need to change your path, plan, or advocate for the original position. During this class you will see examples of how to handle situations when taxpayer’s finances change and the rules you can use to guide us.

About Angelene – Angelene is an IRS Enrolled Agent as well as a Certified Tax Resolution Specialist. She has spent nearly two decades in the trenches alongside industry experts Larry Lawler and LG Brooks working on complex tax resolution cases. She has worked and consulted on many hundreds of cases in her career and is an instructor in the famous ASTPS Tax Resolution Accelerator (formerly known as the Boot Camp).

Conducting a TFRP-Form 4180 Interview

Presented by LG Brooks, EA, CTRS (2 Hours)

Taxpayers are usually “horrified” when they receive a notification from the IRS regarding the pursuit of the potential assessment of the “Trust Fund Recovery Penalty” (TFRP) with respect to the existence of unpaid employee withheld payroll tax.

However, prior to the official “notification” of such proposed action, the IRS is usually required to conduct a detailed & thorough “Interview” of the person who has been identified as ….. potentially “responsible” for the non-payment of the withheld tax and furthermore that has also been deemed as not having paid such withheld tax in a “willful” manner.

Tax practitioners & representatives, when engaged by taxpayers, should be professionally aware of the procedures pertaining to the above referenced “Interview”. The practitioner should employ the appropriate “approach” when representing taxpayers during the presentation of IRS Form 4180, “Report of Interview with Individual Relative to Trust Fund Recovery Penalty”, and equally be aware of taxpayer & representative “rights” during such interviews.

  • Identifying & understanding common “TFRP Engagement Approach’s”
  • How to implement the proper “approach”
  • Understanding the “limitations” of a Revenue Officer during the interview
  • Invoking the “taxpayer’s rights” during a TFRP Interview

About Gary – Gary Bluestein, focuses his practice exclusively on tax representation. Prior to entering private practice, Gary served as a Senior Attorney for the Internal Revenue Service and was a Special Assistant United State’s Attorney. Gary was hired by the Department of Treasury through the Government’s Honors Program. During his Government Service, Gary represented the IRS in both the United States Tax Court and the United States Bankruptcy Court. He also served on several National Task Forces addressing IRS enforcement issues and received numerous Government Merit Awards for his work related thereto.

How To Address Select Information Return Penalties

Presented by Billy L. Fauller, III, EA, CTRS (1 Hour)

You may or may not know about the international penalties associated with Forms 5471 and 5472 but each of these can be staggering. Specifically, there’s no ceiling on Form 5472 penalties. Domestically, there’s a penalty for failing to file W-2’s with intentional disregard. Three very different penalties, but what to do with them? There’s a lot out there, plenty to go over BUT – Did you know that you can leverage facts, circumstances, precedence, AND the IRS’ own internal records to resolve these penalties?

This program will focus on providing an informative view of these penalties along with what you should ask for when asking for internal records, how to prepare your request for penalty relief, alternatives to elevating abatement, and how to “thread the needle” with the IRS.

  • What Forms 5471 and 5472 are all about.
  • How information return penalties are handled at the IRS.
  • Legal theory about international penalties.
